Terms of service

These Terms of Service ("Terms") apply to your use of shop.viajob.com (the "Site") and to any purchase you make from Viajob Inc ("ViaJob Shop", "we", "us" or "our"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, please do not use the Site.

Please read section 16 carefully. It explains how disputes between you and us are resolved.

1. Who can use the Site

  • You must be at least 18 years old, or the age of majority where you live, to place an order.
  • The Site is intended for customers in the United States.
  • If you order on behalf of a company, you confirm that you are authorized to accept these Terms for it.

2. Your account

  • You can shop as a guest or sign in with your email address. Sign-in is provided by Shopify, which sends a one-time code to your email.
  • Keep access to your email account secure. You are responsible for activity in your account, and should tell us right away if you believe someone else has used it.
  • We may suspend or close accounts that break these Terms, for example to stop fraud or abuse of promotions, rewards or reviews.

3. Products and prices

  • We try to describe products, specifications and certifications accurately. Colors and details may look different on your screen, and packaging may change.
  • Prices are in U.S. dollars and do not include sales tax or shipping, which are calculated at checkout.
  • We may change prices, products and availability at any time. A price change does not affect an order we have already accepted.
  • If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel orders for it, even after you receive an order confirmation. If we do, we refund anything you paid.

4. Orders

  • Your order is an offer to buy. We accept it when we ship it. The order confirmation email only confirms that we received your order.
  • We may limit or cancel quantities per person, household or order, and may refuse or cancel any order, for example if a product is out of stock, we suspect fraud or resale, or we cannot verify payment. If we cancel an order, we refund anything you paid.
  • For large or bulk orders, please contact us first.

5. Payment

  • Checkout and payments are processed by Shopify and its payment partners, such as Shopify Payments, Shop Pay, Apple Pay and Google Pay. We do not receive or store your full card number.
  • You confirm that you are authorized to use the payment method you provide.
  • Sales tax is calculated at checkout based on your delivery address, and is shown as a separate line.

6. Shipping and returns

Delivery is described in our Shipping Policy. Returns, refunds and cancellations are described in our Refund Policy. The risk of loss passes to you when the order is delivered to your address.

7. Discount codes and promotions

  • Only one discount code can be used per order. A discount code can be combined with a rewards points discount unless the code says otherwise.
  • Each promotion may have its own conditions, such as a minimum order, eligible products, an end date or a limit of one use per customer. First-order discounts are only for customers who are signed in and have not placed an order before.
  • Discount codes have no cash value, cannot be sold or exchanged, and cannot be applied to past orders.
  • We may cancel a discount, or an order that used one, if the code was obtained or used in a way that breaks its conditions.

8. Rewards program

  • Signed-in customers earn rewards points on eligible purchases and can use them for a discount on future orders, up to the limit shown in the cart.
  • Points have no cash value, cannot be transferred or sold, and are not personal property.
  • Points earned on refunded or canceled orders are deducted, as described in our Refund Policy.
  • We may change the program, including how points are earned or used, with notice on the Site. Changes do not remove points you have already earned, except where points were obtained by fraud or error.

9. Reviews and other content you submit

  • You can review products you have bought. Reviews are checked by our team before they are published.
  • Your content must be honest, based on your own experience, and must not contain advertising, abuse, illegal content, other people's personal information, or material you do not have the right to share.
  • You keep ownership of your content. You give us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, translate and adapt it on the Site and in our marketing, and to show it with your display name.
  • We do not remove reviews because they are negative. We may remove content that breaks these rules.

10. Using the Site

You agree not to misuse the Site, including by: interfering with its operation or security; using bots, scrapers or other automated tools to access it without our permission; trying to access other people's accounts or data; buying products for unauthorized resale using fraud or false information; or using the Site in violation of any law.

11. Intellectual property

The Site, including its design, text, graphics, logos and software, belongs to us or our licensors and is protected by law. You may use the Site only for your personal shopping or your company's purchasing. Product names and brands belong to their owners.

12. Third-party services

Some parts of the Site are provided by other companies, such as Shopify (checkout, payments and customer accounts) and payment providers. Their own terms apply to your use of their services, and we are not responsible for them. Links to other websites are provided for convenience only.

13. Product safety and use

Always follow the manufacturer's instructions, warnings and ratings for the products you buy, especially safety and protective equipment. Products sold on the Site do not replace the safety training, equipment or procedures required by your employer or by law. Make sure a product meets the requirements of your job before you use it.

14. Disclaimers

Except as stated in these Terms and to the extent allowed by law, the Site and all products are provided "as is" and "as available". Any warranty provided by the manufacturer of a product applies to it. To the extent allowed by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available or free of errors. Some states do not allow these exclusions, so they may not apply to you.

15. Limitation of liability

To the extent allowed by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Site or products bought on it. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence.

16. Disputes

If you have a problem with an order or with the Site, please contact us first. Most issues can be solved quickly by email.

If we cannot resolve a dispute by email, any claim arising out of or relating to these Terms, the Site or an order must be brought exclusively in the state or federal courts located in Fort Bend County, Texas. You and we consent to the personal jurisdiction of those courts.

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules.

17. Indemnity

To the extent allowed by law, you agree to defend and compensate us for claims, losses and costs (including reasonable attorneys' fees) caused by your breach of these Terms or your misuse of the Site.

18. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date. The version in effect when you place an order applies to that order.

19. General

  • If any part of these Terms cannot be enforced, the rest remains in effect.
  • If we do not enforce a right, we have not given it up.
  • These Terms, together with the policies they refer to, are the entire agreement between you and us about the Site.
  • These Terms are also available in Spanish and Chinese. If there is any difference between the versions, the English version applies.
